REVISED MEETING NOTICE AND HEARING NOTICE
TOWNSHIP OF LOWER MERION
ZONING HEARING BOARD

Notice is hereby given that the Zoning Hearing Board of Lower Merion Township will hold a Meeting of the Board as authorized by Section 111 of Chapter 155 of the Lower Merion Code, as amended, to take official Board action. Notice is hereby given that the Zoning Hearing Board of Lower Merion Township will hold a Hearing of the Board as required by Section 113 A of Chapter 155 of the Lower Merion Code, as amended, and Section 908 of the Pennsylvania Municipalities Planning Code.

The Meeting shall be held at the Township Building, 75 East Lancaster Avenue, Ardmore, PA, on Thursday, September 20, 2012, at 6:00 PM. The Hearing shall commence immediately following the Meeting and at the same location on the following matters:


Appeal No. 4285

Applicant: Rosemont College
Property: 1414 W Montgomery Avenue (AKA: 1400 Montgomery Avenue) and
1312, 1314, 1316 and 1320 Wendover Avenue, Rosemont, PA 19010
(Election District #6). R 2 and R 1 Residence Districts

Rosemont College proposes to consolidate the parcels and seeks a special exception under §155-11S(2), 11X & 11Y to convert the existing multi-purpose athletic field into a softball field and a separate multi-purpose field including the following improvements: construct a 4600 sq. ft. support building with lockers, restrooms and a concession facility, install field lighting, safety netting, dugouts, benches, a scoreboard, bullpen, backstop, fences, walls and walkways, relocate parking areas and driveways, and use portable bleachers, batting cages, a press box, and PA system. Portions of the improvements would infringe upon steep slopes. The applicant contends that these slopes are manmade and can be built upon by right. Alternatively, they seek a variance from §155-166D to build upon slopes greater than 25%. Further, the applicant seeks any other relief or approvals necessary to allow the proposed improvements.

The appellants have filed a Protective Appeal under the PA Municipalities Planning Code §909.1(3) of the Zoning Officer's determination in an email dated August 13, 2012 that Lower Merion Township Zoning Code §155-76B entitled "Buildings authorized as special exceptions" does not apply to Federal Realty Investment Trust's application in Appeal No. 4280 seeking a special exception under §155-71V "Use regulations" to permit a fitness club use (LA Fitness). The appellants contend that the Zoning Officer must administer the zoning ordinance in accordance with its literal terms and seek a determination from the Zoning Hearing Board that the provisions of §155-76B apply in Appeal No. 4280 and that the Board overturn the Zoning Officer's determination.

Applicant: Federal Realty Investment Trust

(Election District #7) C 1 Commercial and R 7 Residence Districts

This is a continuation of a hearing from 8/20/2012. Federal Realty Investment Trust seeks a special exception under §155-71V to permit a fitness club use (LA Fitness) and contends that the use is of the same general character as the uses specifically permitted in a C 1 zoning district and should be allowed. They also request, to the extent required, any other approval or relief necessary to allow the proposed fitness club use.


Anyone interested in reviewing the applications and plans may review this information in the Building Regulations Division at the Township Building, between 8:15 AM and 4:30 PM, Monday through Friday.
