TOWNSHIP OF LOWER MERION
ZONING HEARING BOARD

Notice is hereby given that the Zoning Hearing Board of Lower Merion Township will hold a Meeting of the Board as authorized by Section 111 of Chapter 155 of the Lower Merion Code, as amended, to take official Board action. Notice is hereby given that the Zoning Hearing Board of Lower Merion Township will hold a Hearing of the Board as required by Section 113 A of Chapter 155 of the Lower Merion Code, as amended, and Section 908 of the Pennsylvania Municipalities Planning Code.

The Meeting shall be held at the Township Building, 75 East Lancaster Avenue, Ardmore, PA, on Thursday, January 10, 2013, at 7:15 PM. The Hearing shall commence immediately following the Meeting and at the same location on the following matters:

The applicant is appealing the violation notice dated 9-28-2012 issued by the Lower Merion Township Housing Officer requiring a special exception under §155-11S(5) to operate a student home for up to three students in this semidetached single-family dwelling. The applicant contends that the use is a legal non-conforming use and can continue as a matter of right. Alternatively, the applicant seeks a special exception under §155-11S(5) and requests a variance from §155-141.3 (Separation requirements), or such other variances or relief necessary to occupy the premises as a student home.

The applicant is appealing the determination of the Zoning Officer that the proposed lot consolidation and Whole Foods Market redevelopment requires Zoning Hearing Board approval to exceed the 70% impervious surface cover maximum as limited by 155-78A(6). The applicant contends that the total existing nonconforming impervious surface cover would be reduced to 77% and should be allowed as a matter of right. Alternatively, the applicant seeks a special exception under 155-100B to permit the irregularly shaped combined building lot to be built upon as proposed, contending that it would be difficult to provide the required open space (the area not covered with impervious surface) for the C 1 zoning district. Alternatively, the applicant requests a de minimis dimensional variance, or in the alternative, a dimensional variance from 155-78A(6) to exceed the maximum impervious surface cover by up to 7%.

Saint Joseph's University seeks a special exception under §155-11S(2) and §155-11X to operate new summer youth athletic camps and clinics on the Maguire Campus to include: 1) a field hockey day camp: two three-day sessions for up to 70 participants per session, 2) a field hockey day clinic: six one-day clinics for up to 60 participants per clinic, 3) a Lacrosse day camp: two three-day sessions for up to 300 participants per session, and 4) a softball day camp: two four-day sessions for up to 75 participants per session.


Anyone interested in reviewing the applications and plans may review this information in the Building Regulations Division at the Township Building, between 8:15 AM and 4:30 PM, Monday through Friday.
